| Content: | European financial regulation has undergone tremendous reforms in recent years. This seminar addresses some of the institutional, regulatory and legal developments in European financial regulation. Some of the institutional developments include the creation of the European Supervisory Authorities and the European Systemic Risk Board, and the new role of the European Central Bank as a bank supervisor. Some of the regulatory developments include a more harmonised framework for the regulation of bank capital and liquidity, clearing houses and trading systems. European policymakers are also considering the proposals in the Liikanen report to 'ring-fence' the investment banking operations of banking groups. Moreover, European banks have been subject to stricter money laundering and terrorist financing sanctions. Finally, EU regulatory developments are having a substantial impact on Switzerland as a financial centre. | |

| Topic: | 'Financial Sanctions' have become the modern weapons of developed countries and international organisations to set pressure on countries, persons or entities in order to combat ways of organised crime like corruption, money laundering or financing of terrorism. Under this title the upcoming seminar offers you a wide range of practical international and comparative research topics. It covers for example the history, development and form of targeted financial sanctions; their regulatory structure from measures imposed by national authorities to resolutions of the relevant inter-governmental institutions and their functions (e.g. United Nations, European Union, FAFT); the anti-money laundering and combatting the financing of terrorism recommendations of the Financial Action Task Force (FATF) and their impact on the parties concerned; the distinction and interaction of financial sanctions and economic sanctions (e.g. restrictions on the free movement of capital and payments); the functionality and self-assertion of enforcement mechanisms; private enforcement; the impact of financial sanctions on the banking and securities regulation; financial (and economic) sanctions and related corporate law issues as corporate governance, control liability or third-party liability. Related issues involving the financing of weapons of mass destruction and EU and US sanctions on Iran will be addressed and the effect of sanctions on third countries, such as Switzerland. | |

| Topic: | The title of this seminar is 'International Financial Law' - this is broadly conceived. This covers international banking and securities regulation (Basle Accord and Internatioal Organization of Securities Commission ( IOSCO) standards) or international anti-money laundering standards, including anti-terrosim sanctions adopted by the Financial Action Task Force and implemented by the European Union and United Nations Security Council. Other related areas include the International Monetary Fund's role in promoting financial stability and serving as a lender of last resort for sovereign debtors. The role of the IMF in the current eurozone crisis and its contribution to the bailouts of Greece, Ireland and Portugal. Also, the IMF's role in coordinating with G10 central banks the General Arrangements to Borrow and the New Arrangements to Borrow. Also, developing international norms of insurance regulation especially with respect to insurance solvency regulation (known as 'Solvency II' in Europe). Another area of focus could address the interaction of legally non-binding international financial soft law standards with EU and national legal systems: focusing on different approaches of implementation and whether this leads to harmonisation or convergence etc. Finally, the role of the G20 in overseeing the Financial stability Board and other international financial bodies and how G20 can interact with the IMF. What does macro-prudential regulation mean in today's globalised financial markets and what types of institutions are necessary to achieve its objectives. Some students may want to focus on law and development issues in developing countries; this look at the effectiveness of the World Bank's economic and financial development programmes for building financial services sectors in developing countries. More theoretical work could look at the formation of certain legal norms on a transnational basis (ISDA derivative contracts and bank corporate governance principles) by multi-national financial firms and how they are recognised and embedded in national legal systems . Other related areas would be international norms influencing bank secrecy and anti-tax avoidance. | |
