Targeted Update of the OECD Guidelines for Multinational Enterprises
The OECD Guidelines for MNEs are undergoing a targeted update. The Guidelines were last revised in 2011 and the targeted update aims at keeping them fit for purpose, especially with regard to the impacts of business on the environment and regarding advancing technological development. A first consultation draft has been published in January 2023 and was open for public consultation until 10 February 2023. The updates of the text focus on the chapters on the environment and on science and technology as well as the implementation procedures for the National Contact Points on Responsible Business Conduct. Switzerland’s National Contact Point issues a final statement on the BKW Energie AG case – GfbV Switzerland (26 August 2021)
The Swiss National Contact Point (NCP) has issued its final statement on the complaint lodged by the Society for Threatened Peoples Switzerland against BKW Energie AG. In January 2020, the complainant alleged a breach of the OECD Guidelines for Multinational Enterprises on the grounds that BKW had failed to fulfil its human rights due diligence obligations in relation to its minority stake in a wind energy project in Norway, which is planned in the territory of the indigenous Sami people. The Swiss NCP offered its good offices, and four mediation meetings between the parties took place over the course of last year. The open and constructive discussions led to a fruitful outcome: BKW will strengthen and optimise its due diligence processes, particularly with regard to its engagement with indigenous peoples. The parties will maintain their dialogue.
