Gastprofessorinnen und Gastprofessoren

Die RWF empfängt auf Antrag der Lehrstühle  Gastprofessor/innen. Die Gastprofessor/innen verbringen in der Regel zwei bis drei Wochen an der RWF und werden aktiv in die Lehre und die Fakultät eingebunden.

Die Rechtswissenschaftliche Fakultät RWF hat die Ehre, die folgenden  Gastprofessoren im Herbstsemester 2026 zu empfangen:

Family law governs some of the most consequential decisions in people’s lives, including whether and whom to marry, whether to divorce, and how to structure spouses’ economic relations. Yet, despite the centrality of human judgment and motivation in these domains, behavioral analysis has had only limited influence on family law scholarship and policy. Drawing on research from the psychology of judgment and decision-making, Prof. Zamir will examine how cognitive biases, emotions, and non-selfish motivations shape decisions within intimate relationships and how legal rules interact with these behavioral dynamics. It will be argued that the distinctive features of family law—altruism, intense emotions, and the law’s longstanding reluctance to intrude into private life—both complicate and heighten the relevance of behavioral insights. Through a systematic analysis of marriage and divorce decisions, marital property regimes, and marital agreements, Prof. Zamir will demonstrate how behavioral considerations can illuminate existing doctrines and inform legal design. The presentation will offer concrete policy recommendations, including the use of waiting periods, counselling, and default rules to improve decision-making while respecting autonomy. More broadly, it will claim that engagement with family law can enrich behavioral legal analysis itself by expanding its attention beyond cognition to include emotion, altruism, and legal restraint.
