Residential and Commercial Tenancy Law (in German)

The lecture on Residential and Commercial Tenancy Law is co-taught by attorney Dr. Urban Hulliger and Prof. Dr. Alessia Dedual. The precise allocation among the lecturers is indicated in the lecture schedule (see below).

The aim of the course is to introduce students to the theoretical and practical issues of residential and commercial tenancy law. Residential and commercial tenancy law refers to the regulations governing the rental of residential and commercial premises within the scope of the Swiss Code of Obligations (CO [OR]) and ancillary legislation, such as the Ordinance on the Rental and Leasing of Residential and Business Premises [Verordnung über die Miete und Pacht von Wohn- und Geschäftsräumen, VMWG].

The course covers issues relating to rent determination, protection against termination (including rent extensions), and tenants’ rights in cases of defects. In addition, the transfer of leases, the early return of leased premises, and subletting are addressed. With particular regard to commercial leases, the course also examines shell leases and triple-net lease agreements.

The presentations for each lecture and additional documents will be published on OLAT before the respective teaching unit.
