Method

The research focussed on the observation of proceedings before various courts. In addition, further data relevant to the empirical evaluation was collected through standardised interviews with those involved in the proceedings. The subjective assessment of these persons was of particular interest, but also the collection of further information that could not be obtained through observation alone. The additional empirical results obtained through the surveys are used for quantitative and qualitative evaluation.

Results

The project consists of an empirical and a theoretical component: The empirically collected data forms the basis for the theoretical approach. The extensive database enables a comparative analysis between the actual procedural practice in Switzerland and the normative conception or view of fairness as developed in Article 6 ECHR and the case law of the European Court of Human Rights (ECtHR).

Once the evaluation of the data material and the theoretical analysis have been completed, the results obtained will be published in the form of various articles in specialist journals. In addition, a corresponding book will be published, which is currently still in preparation.
