The seminar addresses the question which influence the Holocaust had on the post-war development of national and international law. It addresses fundamental theoretical and quite concrete practical problems. It is situated in the context of a discussion where the thesis that especially the post-war development of the human rights culture cannot be understood without reference to the experience of the Holocaust and the normative conclusions drawn from it, is under critical scrutiny not the least by a new generation of legal revisionist historians. The seminar wants to trace the possible effect of the Holocaust in various areas of the law from international human rights law to constitutional law of different states.
It will be taught together with Prof. Dr. Mordechai Kremnitzer, Hebrew University of Jerusalem (link, opens in a new window), a particularly distinguished scholar in the fields of international human rights law and criminal law. The seminar will be taught in English and German; the participants may choose in which language they would like to write the paper and present the assigned topic.
The preparatory meeting will be held on April 3 2014, at 16.00 in RAI-J-031.
The seminar will be held as a block seminar, probably on october 8 to 11, in the pavilion of the Seeclub Zürich. The fee will be about 100 SFR to cover the catering.
The deadline for the submission of the seminar papers is september 19 2014.
Grundrechte sind in der Schweiz und in vielen anderen Staaten zu prägenden Gestaltungsprinzipien der gesamten Rechtsordnung geworden. Die heutige reiche Grundrechtspraxis und -dogmatik ist das Resultat einer eindrucksvollen rechtlichen Entwicklung, die von vielfältigen Theorieansätzen beeinflusst wurde. Das Seminar geht den Fragen nach, welche Theorien diese Entwicklung der Grundrechte besonders geprägt haben und welche Annahmen diesen Theorien – und somit in weiten Teilen auch unserem heutigen Grundrechtsverständnis – zugrunde liegen. Im Seminar sollen sowohl grundsätzliche Probleme der Begründung von Grundrechten wie auch die praktischen Folgen der unterschiedlichen Theorieansätze anhand einzelner ausgewählter Grundrechtsgarantien beleuchtet werden.
