International Arbitration and Civil Antitrust Law

Due to the current revision of Swiss antitrust law, Yves Loher has addressed in this book the impact of the increased relevance of civil antitrust law and related civil proceedings. This is because the importance of these issues is also increasing in arbitration, although they pose practical problems in international arbitration proceedings. This book analyses proposed solutions and obstacles to these hurdles.

In particular, the author deals with the affiliation of antitrust law provisions to public policy and the qualification of antitrust law provisions as overriding mandatory provisions.

Data cooperation

In this volume, Robin Landolt takes an in-depth look at the current legal framework for data co-operation.

Companies regularly procure resources through co-operation with other market participants. However, data is often only used within the company because there are economic or data protection risks associated with cross-company use.

The fact that more and more data protection regulations, such as the Data Act, are being created in the EU to promote such cross-company use of data has given rise to a presentation of the current legal framework in Switzerland. Its weaknesses and design options are also highlighted.

Telematics and Motor Vehicle Insurance

In this book, Lara Blumer examines specific telematics clauses, as contract models based on the analysis of customer behaviour are becoming increasingly important. Pre-contractual and insurance-related particularities are analysed. The use of telematics is also categorised in terms of contract law.

The author focusses in particular on the revised VVG and data protection law, with a special focus on issues relating to the granting of discounts and changes in risk as a result of the interruption of telematics services or changed score values. The book thus serves as a guide to various questions that may arise in connection with telematics insurance for motor vehicles.

Code-based regulatory System

This publication, written by Rhea Specogna, deals with the necessity of anchoring smart contracts in traditional state law and whether they can also be integrated into purely code-based regulatory systems. The author discusses the concept and legal basis of smart contracts, with a particular focus on dispute resolution in connection with such contractual relationships. In this context, the New York Arbitration Convention and the international enforcement of arbitration awards are also discussed, taking into account the limitation of party autonomy under arbitration law by state jurisdiction.
